The Illinois Department of Public Health recently revealed the list of nursing homes in Illinois have violations in the fourth quarter of 2008.  A nursing home's name on the list indicates that the Illinois Department of Public Health has initiated action against the following facilities which have been determined to be in violation of the Nursing Home Care Act, or has recommended decertification to the Director of the Illinois Department of Healthcare and Family Services, or the Secretary of the U.S. Department of Health and Human Services for violations in relation to patient care, pursuant to Titles XVIII and XIX of the Social Security Act.

A closer look of the 43 Illinois Nursing Homes on the list reveals many of the facilities are repeat customers and are relatively evenly dispersed around the State of Illinois.  The average Medicare star rating for the facilities is just 1.72 out of a possible 5 stars when looking at each facilities overall rating. Put another way, these facilities poor ratings are well deserved.

The Illinois Department of Pubic health has posted the third quarter violations on their website.  The listing of 47 Illinois Nursing Homes indicates the facilities where the Illinois Department of Public Health has determined the facility to be in violation of the Nursing Home Care Act or recommended de-certification to the Director of the Illinois Department of Healthcare and Family Services, or the Secretary of the U.S. Department of Health and Human Services for violations relating to patient care.

Put another way, pay special attention to the facilities on this list.  Some are on the list for the first time while others are repeat offenders.

Bloomberg reported that more than 90 percent of U.S. nursing homes in each of the past three years were cited for violating federal standards, according to a government report.  The article substantiates that many nursing homes are simply not doing an adequate job caring for our nations elderly population.  According to the inspector general's report for the Department of Health and Human Services:

• For-profit facilities had a higher percentage of violations than other nursing homes-94% of for-profit nursing homes surveyed were cited for deficiencies, compared to 88% of not-for- profit and 91% of government nursing homes
• The most common violations related to improper storage and distribution of food, accident hazards and lack of services necessary for residents' mental and physical well-being

• The rate of violations differed by state, with every nursing facility surveyed in Alaska, the District of Columbia, Wyoming and Idaho reporting citations compared with a low of 76% in Rhode Island.

There are 1.5 million people living in 16,000 nursing homes in the United States.  The facilities are reliant on government payments for the vast majority of their operating budget.  In order for the facilities to be reimbursed by Medicare and Medicaid, the nursing homes must be certified as meeting certain federal standards.

According to Susan Feeney, a spokeswoman for the American Health Care Association, a Washington advocacy group for 9,000 nursing homes, nursing home inspections are too subjective.  ``We're looking to work with Congress and the administration to implement a process that's less subjective and has incentives for quality improvement,'' Feeney said.

Federal and state regulation of nursing homes provides essential guidelines for the safety and well-being of nursing home residents.  In order to provide the safest environment for nursing home residents, all aspects of the facilities need to be properly monitored.  Any efforts on the part of the nursing home industry to relax or eliminate the standards should be considered self-serving.

The Illinois Department of Public Health released is listing of nursing homes from the 2008 second quarter.  The listing has nursing homes that  the IDPH has determined to be in violation of the Nursing Home Care Act.  In some situations, IDPH has recommended decertification to the Director of the Illinois Department of Healthcare and Family Services, or the Secretary of the U.S. Department of Health and Human Services for violations in relation to poor patient care, pursuant to Titles XVIII and XIX of the Social Security Act.  Further, these facilities have 'type A' violations indicating that the conditions at the facilities pose imminent harm or death to the residents.

Most of the above violations were made following a complaint initiated by a resident or their family.  If you believe a facility is treating its residents improperly or the resident is at risk for harm make a report of the incident today.

Nursing Homes must meet certain Federal and State guidelines in order to receive money and keep their accreditation. Investigators periodically go to the facilities to ensure compliance. A recent New York Times article suggests that even these 'professional' nursing home investigators miss obvious safety violations.

According to the Mr. Morris, one of the studies sponsors, even some of the most obvious problems with nursing home residents went unnoticed.  "We’ve found patients with maggot infestations in wounds and dead flesh. We’ve found residents with broken bones that went unmended.”

This article raises the question: what can you do to assure your family member is in a satisfactory facility? Here are several basic things to look for when selecting a nursing home:

• Make multiple unannounced visits at different times
• Look at the residents, do they seem happy?
• Ask friends about the facility
• Does the staff know the residents by their names?
