Surveillance video from the nursing home demonstrated that an Alzheimer's patient that the staff was responsible for supervising wandered without any intervention from the safety of the nursing home into the frigid outside temperatures.  Hours after the patient left the nursing home, he was found dead outside.  An autopsy revealed... Assisted Living Facility Willing To Forgive & Forget Nurse's Criminal Past

Everyone deserves a second chance--- or do they?  What about when the individual has a past that makes him / her particularly unsuitable for a particular job?  What if the person is working with particularly vulnerable people?  Should we just ignore the person's past indiscretions and give them the opportunity to redeem themselves? While I can appreciate the gesture of giving someone a new beginning, I certainly hope that it's not done with the safety my family member at stake! A news story about an admitted drug user and thief-- seemingly two times over--  caught my attention-- not so much... More

CNA Arrested After Soliciting Sexual Favors From Resident

Apparently, a history of criminal financial behavior wasn't enough to discourage the owners of Waterbook Assisted Living from hiring Katonia Davis as a CNA at their facility--- because she wasn't going to be handling any of the finances at the facility. Yet, just four months into her tenure at the North Carolina assisted living facility, Ms. Davis apparently couldn't control the strong feeling she had for a resident at the facility that she was to care for.  Another employee at the facility witnessed Ms. Davis pay the resident $20 for him to perform sexual acts with her. While Davis... More

Criminal & Civil Charges Brought Against Sunrise Facility After Videotaped Abuse

The family of a Pennsylvania assisted living patient has initiated a civil lawsuit against Sunrise Senior Living, a popular chain of assisted living facilities, after a hidden video demonstrated that three employees at the facility were abusing their 78-year-old mother. The family installed the hidden camera after they suspected that their mother was being mistreated at the facility. According to news reports, the families concerns were discarded by officials at Sunrise due to the fact that their mother suffered from Alzheimer's making alleging her condition made her incapable of accurately articulating the abuse. In addition to the civil lawsuit against... More

Nursing Home Cover-Up: NY Aides Lied About Doing Their Jobs

As a nursing home lawyer, I spend a lot of time reviewing patient charts.  Particularly when it comes to evaluating cases, a thorough review of medical records is crucial for determining the important questions: Who? What? Why?  When?  Occasionally, my chart reviews reveal more than I expect when: medication charts reveal that medication was administered for days after my client was transferred to another facility.  Or on one occasion, there were nurses’ notes for hours following a client’s death. When I see serious charting errors, I makes me question not just the care surrounding a particular incident, but all care... More

Nurse Facing Criminal Charges After Intentionally Neglecting Ventilator Patient

Perhaps Abiodun Oke should be shoveling asphalt or a similar occupation where a person's compassionate side is not necessarily crucial to the job? On the other hand, as a licensed practical nurse (such as Mr. Oke)--- or really any profession responsible for caring for the elderly-- I would suggest have substantial dose of compassion as they are the ones who are responsible for providing the daily care necessary for some of the most fragile members of society. The reason I suggest that Mr. Oke look for a more physical type of work is that he faces criminal charges relating to... More

Nursing Home Abuse: Workers' Prank In Applying Grease To Dementia Patients In California Results In Criminal Charges

A demented sense of humor amongst nursing home workers at Valley View Skilled Nursing Facility seems to have backfired-- and has landed a group of them jobless and facing criminal charges.  The fallout stems from an incident in which four employees at the California nursing home, covered dementia patients at the facility with lubricant from head to toe, making the patients slippery for staff on the next shift to handle.  In the wake of the incident and following investigations from the nursing homes parent company, Horizon West Healthcare and the California Attorney General's Bureau of Elder Abuse, it was determined... Court Determines Nursing Home Corporation Can't Be Criminally Prosecuted For Employees' Negligent Conduct

The collective negligence of multiple nursing home employees does not impute criminal conduct on the part of the corporate owner according to a recent ruling made the Supreme Judicial Court-- the highest court in Massachusetts. The decision stems from the death of a 74-year-old patient at a MA nursing home owned by Life Care Centers of America.  Despite the patient's extensive history with respect to wandering from the facility, the facility failed to take basic precautionary measures that would likely prevented the wheelchair-bound patient from falling down a set of stairs to her death. An investigation into the patient's death... More

Health Care Company Rips Off State By Providing Less Skilled Workers To Care For Ventilator Patients

Criminal charges have been filed against Barbara Currin, the owner of Ometta Vent Care Services. The criminal charges come after a patient Currin was responsible for caring for, tipped off state officials she was not receiving the medical care that the state was paying for.   The tip initiated an investigation by the Minnesota Department of Health and the Minnesota Attorney General.  Both agencies concluded that Ometta was not keeping up its end of the bargain in proving skilled nursing services for vent patients. According to Attorney General Lori Swanson said, "The nursing facility deprived patients who are very in... More
